Terms of Service

These Terms of Service ("Terms") govern your access to and use of mypursuit.co and the PURSUIT application (together, the "Service"), operated by Brandon L Pickett LLC, d/b/a Pursuit ("PURSUIT," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms.

1. The Service

PURSUIT helps you organize a job search — collecting job postings, scoring how well they fit you, tailoring resumes and cover letters from your own real experience, tracking your application pipeline, and preparing you for interviews. PURSUIT never submits an application on your behalf; you always review and click submit yourself on the employer's site. PURSUIT is a tool — it does not guarantee any particular interview, offer, or employment outcome.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Subscriptions and Billing

Paid plans are billed in advance on a recurring basis through Stripe. Unless stated otherwise at signup, subscriptions renew automatically until cancelled. You can cancel at any time from Settings → Billing; cancellation keeps your access through the end of the period you've already paid for, then reverts you to the Free plan — nothing is deleted. We do not provide refunds for partial periods except where required by law. We may change our pricing with reasonable advance notice.

4. Acceptable Use

You agree not to use the Service to:

• Generate or submit application materials containing information you know to be false, or that misrepresent your identity, qualifications, or work history;
• Scrape or connect to a job board or employer system in a way that violates that platform's stated terms;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to gain unauthorized access to the Service or its related systems; or
• Use the Service in violation of any applicable law.

We may suspend or terminate accounts that violate this section.

5. Your Content

You retain ownership of your resume, accomplishment library, job data, and any other content you input into or generate through the Service ("Your Content"). You grant PURSUIT a limited license to host, process, and transmit Your Content solely as needed to provide the Service to you.

Generated resumes, cover letters, and interview prep are built to trace back to real experience you entered — you are still responsible for reviewing any AI-generated material before using it, and for its accuracy before you submit it anywhere.

6. Our Intellectual Property

The Service itself — including its software, design, and branding — is owned by PURSUIT and protected by intellectual property laws. These Terms do not grant you any rights to PURSUIT's trademarks, logos, or underlying technology beyond what's needed to use the Service as intended.

7. Third-Party Services

The Service relies on and integrates with third-party providers (including AI model providers, payment processors, and any job board you connect). We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them is subject to their own terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE, OR THAT USE OF THE SERVICE WILL RESULT IN ANY PARTICULAR JOB SEARCH OUTCOME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURSUIT AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10. Indemnification

You agree to indemnify and hold PURSUIT harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

11. Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, with notice where reasonably practicable.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Colorado, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
